2.1 What Sensei Elite Provides

Sensei Elite is an AI-powered coaching platform for Lean Six Sigma practitioners. The Service includes:

• AI-driven project coaching across DMAIC, DMADV, Kaizen, and other methodologies
• Guided playbooks and structured tools (Charter, SIPOC, VOC, FMEA, and more)
• Project management and artifact creation
• Optional live coaching sessions with human experts (plan-dependent)

2.2 Eligibility

To use Sensei Elite, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Provide accurate and complete registration information
• Not use the Service for critical business decisions without independent verification

2.3 Account Security

You are responsible for maintaining the security of your account. You agree to:

• Keep your password confidential and not share it with any third party
• Not share your account or login credentials with others
• Notify Provider immediately at mike.higgins@consusone.com if you become aware of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

Provider is not liable for any loss or damage arising from unauthorized use of your account credentials. If the provider suspects unauthorized access or a security breach, we may suspend your account to protect you and other users.

3. Free Trial

3.1 Trial Terms

New Users receive a thirty (30) day free trial with full access to Pro plan features. No credit card is required to start the trial.

3.2 Trial Expiration

When the trial period ends:

• You must subscribe to a paid plan to continue using AI coaching features
• Your existing project data is preserved and is not deleted
• You may subscribe at any time after trial expiration to regain full access

3.3 AI Methodology & Hallucinations

You acknowledge that while the Service is designed for Lean Six Sigma coaching, AI may occasionally generate incorrect statistical conclusions or methodology errors ("hallucinations").

3.4 Human-in-the-Loop (HITL) Requirement

In accordance with 2026 AI governance standards, the Service is a coaching aid only. Users must independently verify all AI Output — especially statistical calculations and project milestones — before implementation in a professional or manufacturing environment.

4. Subscription Plans and Pricing

4.1 Available Plans

4.3 Coaching Session Policy

• Coaching sessions included with Pro + Coaching are use-it-or-lose-it and reset each billing cycle. Unused sessions do not roll over.
• Add-on sessions do not expire and may be used at any time while you maintain an active subscription.

4.4 Pricing Changes

Provider reserves the right to change pricing with at least thirty (30) days' advance notice.

5. Billing and Payments

5.1 Payment Processing

All payments are processed by Stripe. ConsusOne LLC does not store your credit card information.

5.2 Auto-Renewal

Subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before the renewal date.

5.3 Cancellation

• You may cancel at any time through your account settings via the Stripe Customer Portal.
• Upon cancellation, you retain access through the end of your current billing period.
• After the billing period ends, your project data is preserved but paid features are suspended.

5.4 Refund Policy

No refunds are issued for partial billing periods. If you cancel mid-cycle, you continue to have access until the end of the period you have already paid for.

5.5 Failed Payments

If a payment fails, Stripe will automatically retry. If all retries fail, your account will be downgraded until a valid payment method is provided.

5.6 Chargebacks and Payment Disputes

If you have a billing concern, you agree to contact Provider at mike.higgins@consusone.com or visit lsssensei.com/contact before initiating a chargeback or dispute with your bank or credit card company. Provider will make reasonable efforts to resolve billing issues promptly.

If a chargeback is filed:

• Provider may suspend your account pending resolution of the dispute
• Provider will submit evidence to the payment processor to contest fraudulent or unwarranted chargebacks
• Fraudulent chargebacks (e.g., disputing a charge for a service that was used) may result in permanent account termination
• You may be responsible for any fees incurred by Provider as a result of a fraudulent chargeback

6. Disclaimers and Warranties

6.1 "AS IS" Provision

Sensei Elite is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including:

• No warranty of merchantability — May not be suitable for your specific purpose
• No warranty of fitness — May not meet your project requirements
• No warranty of accuracy — AI Output may be incorrect or incomplete
• No warranty of availability — Service may be interrupted or unavailable
• No warranty of data preservation — We do not guarantee against data loss

6.2 No Reliance on AI Output

7. Data Handling and Privacy

7.1 What Data We Collect

• Authentication data: Email address, Google account information
• Project data: Project names, methodology selection, phase progress
• AI Input: Chat messages, project context, and questions submitted to the AI
• AI Output: AI-generated coaching responses and recommendations
• Saved artifacts: Charter, SIPOC, VOC, FMEA, and other tools you create
• Usage metadata: Login times, feature usage, browser information
• Payment data: Subscription status and billing history (credit card details stored by Stripe only)

7.2 How We Use Your Data

• Provide the Sensei Elite coaching service
• Process AI Input through Google Gemini API to generate AI Output
• Process payments and manage subscriptions (via Stripe)
• Send transactional communications (via Resend)
• Improve the product and coaching quality, which may include review of project content and AI interactions by authorized personnel (see Section 7.5)
• Debug technical issues

7.3 Data Storage and Security

• Storage: Firebase Firestore (Google Cloud Platform, United States)
• Encryption: HTTPS in transit; Google-managed encryption at rest
• Access: Only you and the Provider can access your data
• Isolation: Your data is isolated from other users via Firebase Security Rules
• Payments: Credit card data handled exclusively by Stripe

7.4 AI Data Processing

When you submit AI Input:

• Your AI Input is sent to Google Gemini AI
• Google processes requests ephemerally (no long-term storage)
• Google does not train models on your data per their API terms
• Your AI Input and AI Output are not shared with other users
• Provider does not use your specific Project Data or AI Input to train, fine-tune, or improve its proprietary models for use by other subscribers

7.5 Service Improvement and Quality Assurance

To improve coaching quality and the accuracy of Lean Six Sigma recommendations, authorized ConsusOne personnel may review AI Input, AI Output, and project content. We limit this access to personnel who need it for service improvement, troubleshooting, or support, and treat your content as confidential.

7.6 Transactional Communications

We use Resend to send transactional emails. You may not opt out of transactional communications while maintaining an active account.

7.7 Data Retention

• Active accounts: Data retained as long as your account exists
• Cancelled accounts: Data preserved for ninety (90) days, then may be deleted
• Deletion: You can delete individual projects at any time
• Account deletion: Contact mike.higgins@consusone.com or visit lsssensei.com/contact

7.8 No Sensitive Data

7.9 Data Breach Notification

If we become aware of unauthorized access to your data, we will:

• Notify you via email within 72 hours
• Describe what data was affected
• Explain steps we are taking to remediate
• Provide guidance on protective actions you can take

8. Acceptable Use Policy

8.1 Permitted Use

• Coach yourself through Lean Six Sigma projects
• Generate ideas for process improvement
• Create project artifacts (Charter, SIPOC, VOC, FMEA, etc.)
• Learn Lean Six Sigma methodology
• Participate in live coaching sessions (if included in your plan)

8.2 Prohibited Use

You may NOT use Sensei Elite to:

• Generate harmful, illegal, or unethical content via AI Input
• Attempt to reverse-engineer, decompile, or otherwise analyze the AI prompts, system architecture, or underlying coaching logic to obtain trade secrets, conduct competitive intelligence, or obtain proprietary information for the purpose of developing a competing product or service
• Overload the system with excessive requests
• Share your login credentials with others
• Use automated tools (bots, scrapers) to access the Service
• Extract or republish AI Output for commercial purposes without authorization
• Circumvent security controls or access other users' data
• Resell, sublicense, or redistribute the Service

8.3 Enforcement

Violation may result in immediate suspension or termination of your account, without refund.

8.4 No Use by Competitors

Direct competitors of ConsusOne LLC, including any entities or individuals engaged in the development of AI-based coaching tools or Lean Six Sigma software, are strictly prohibited from accessing or using the Service for any purpose, except with Provider's prior written consent. If you are a competitor, any use of the Service constitutes a material breach of these Terms.

9. Intellectual Property

9.1 Your Data Ownership

You retain ownership of all AI Input and User Data you submit, including project information, questions, and artifacts.

9.2 AI Output

• Non-exclusive — Similar AI Output may be generated for other users
• Not guaranteed to be original — AI may produce content similar to existing works
• Your responsibility to verify — You must ensure published content derived from AI Output does not infringe third-party rights

9.3 Sensei Elite Platform

All rights to the platform — including code, design, branding, prompts, and algorithms — remain the exclusive property of ConsusOne LLC.

9.4 Feedback License

If you provide feedback or suggestions, you grant Provider a perpetual, royalty-free license to use that feedback to improve Sensei Elite.

10. Limitation of Liability

10.1 Maximum Liability

Provider's total liability shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

10.2 No Consequential Damages

Provider is NOT LIABLE for: lost profits, lost data, business interruption, reputational harm, opportunity costs, or indirect/incidental/special/punitive/consequential damages, EVEN IF advised of the possibility.

10.3 Scenarios Where Provider Is Not Liable

• Service downtime causing lost work
• AI Output leading to failed Lean Six Sigma projects, poor outcomes, or methodology hallucination
• Data exposure due to security breach despite reasonable safeguards
• Service unavailability during critical deadlines
• AI Output infringing third-party intellectual property
• Business decisions based on AI Output resulting in losses, including but not limited to, incorrect process improvement implementation

10.4 Assumption of Risk

You assume all risks associated with using AI Output for your projects and business decisions.

11. Indemnification

You agree to indemnify and hold harmless Provider from any claims, damages, losses, or expenses arising from:

• Your use of Sensei Elite
• Your violation of these Terms
• Your violation of any third-party rights
• Decisions you make based on AI Output
• Any content you publish derived from AI Output

12. Data Export and Portability

• Copy/paste: Manually copy conversations and artifacts from the application
• Request: Email mike.higgins@consusone.com for a data export (allow 5–7 business days)
• No automated API or bulk export feature is currently available.

13. Account Termination

13.1 Termination by You

You may cancel your subscription and close your account at any time.

13.2 Termination by Provider

• Violation of these Terms or Acceptable Use Policy
• Non-payment after all retry attempts have failed
• Security concerns
• Any reason with thirty (30) days' written notice

13.3 Effect of Termination

• Access ceases at end of billing period (your cancellation) or immediately (for cause)
• Project data retained for ninety (90) days for export
• After ninety (90) days, data may be permanently deleted

14. Changes to Terms

• Provider may modify these Terms at any time
• Material changes: email notice at least fourteen (14) days before taking effect
• Continued use after changes constitutes acceptance
• If you disagree, cancel your subscription before changes take effect

15. Dispute Resolution

15.1 Informal Resolution

Contact mike.higgins@consusone.com or lsssensei.com/contact before pursuing legal action. Both parties agree to negotiate in good faith for at least thirty (30) days.

15.2 Governing Law

Governed by the laws of the State of Georgia, United States.

15.3 Jurisdiction

Legal actions shall be brought exclusively in the state or federal courts located in Georgia.

16. Miscellaneous

• Entire Agreement: These Terms supersede all prior agreements.
• Severability: If any provision is unenforceable, the remainder stays in effect.
• No Waiver: Failure to enforce does not waive Provider's right to enforce later.
• Assignment: You may not assign your rights. Provider may assign to a successor.
• Force Majeure: Provider is not liable for delays due to circumstances beyond reasonable control.

17. Contact Information

Acknowledgment and Acceptance

By clicking "I Agree," creating an account, or using Sensei Elite, you acknowledge that:

• You have read and understood these Terms of Service
• You agree to be bound by these Terms
• You understand the Service is provided "AS IS" without warranty
• You will independently verify all AI Output before acting on it
• You will not enter sensitive or regulated data into the Service
• You accept the limitation of liability described herein
• You understand that subscription fees are non-refundable for partial billing periods
• You acknowledge and consent to the review of project content and AI interactions by authorized personnel for service improvement, troubleshooting, and support, as described in Section 7.5
